924 Broadway, Application for Legalization of Window Replacements

At the regularly scheduled monthly Community Board Five meeting on Thursday, February 08, 2024, the following resolution passed with a vote of 33 in favor; 0 opposed; 1 abstaining:

WHEREAS, 924 Broadway (Building), a four-story commercial building, is located between East 21st Street and East 22nd Street on the east side of Broadway in the Ladies' Mile Historic District; and

WHEREAS, The Building was originally constructed around 1854 as one of several rowhouses and thereafter in 1880, 924 Broadway and 926 Broadway were merged together and furthermore in 1921, among other alterations, large windows in the second through the fourth stories were installed in the Building and in addition, the present Building facade, which has been modified extensively over time, may date from 1950; and

WHEREAS, Previous tenants of the Building have included Kimbel & Cabus, the producers of furniture and interior decoration, in 1862-63, Wakefield Rattan Furniture in 1880, and Westcott Express Company in 1911; and

WHEREAS, The Applicant received LPC approvals on October 14, 2008, for window replacements in the Building; and

WHEREAS, The Applicant has put window replacements in the Building on the second and third floors that are not in compliance with LPC approvals; and

WHEREAS, The Applicant's non-compliance includes the installation of windows and transoms in the Building that are not in compliance with the sizes and proportions approved by LPC; and

WHEREAS, The Applicant's non-compliance includes the installation of a double-hung operable window in the Building that is not approved by LPC; and

WHEREAS, The Applicant's non-compliance includes the installation of aluminum window frames (instead of galvanized steel ones) in the Building that are not approved by LPC; and

WHEREAS, The Applicant seeks legalization of the aforementioned non-compliant window replacements; and

WHEREAS The aforementioned window replacements are appropriate for the Building and the Ladies' Mile Historic District; and

WHEREAS, The benefit of requiring the Applicant to redo the window replacements does not justify the cost; and

WHEREAS, the Applicant has not been deemed to have acted in bad faith; and

WHEREAS, Community Board Five generally takes an unfavorable position toward legalization requests, a recommendation of approval may be made when legalization is deemed appropriate for a landmark and a historic district and when an applicant has not been deemed to have acted in bad faith; therefore be it

RESOLVED, Community Board Five recommends approval of the legalization of the non-compliant window replacements at 924 Broadway.
