CB5 Review of Adult-Use Cannabis Retail Dispensary Licenses
At the regularly scheduled monthly Community Board Five meeting on Thursday, December 14, 2023, the following resolution passed with a vote of 32 in favor; 2 opposed; 1 abstaining:
WHEREAS, New York State has legalized the production, sale, and use of recreational cannabis, which authorized the ability of the State to license retail cannabis dispensaries and establishments for on-site consumption; and
WHEREAS, The regulation of these establishments will be handled by the State, and the State has created a State Cannabis Control Board (the “CCB”) for that purpose; and
WHEREAS, Manhattan Community Board Five (“CB5”), at its February 2023 full board meeting, adopted guidelines (the “CB5 Cannabis Guidelines”) by which CB5 shall be transparent and uniform in our review and evaluation of cannabis applications within our district and so that we may provide consistent feedback on such applications to the CCB; and
WHEREAS, The applicants listed on Schedule A attached hereto (the “Applicants”) to which this resolution applies, have notified CB5 of their intention to apply for an Adult-Use Retail Cannabis License (the “Licenses”) at locations within CB5; and
WHEREAS, As provided in the CB5 Cannabis Guidelines, CB5 has found that the following location requirements are reasonable for CB5 to approve a License in our district:
1) Applications in CB5 shall be considered compliant with respect to location provided those locations (the “Compliant Locations”) are no less than:
And for retail establishments only, the following additional distance requirements:
WHEREAS, This resolution provides guidance solely with respect to the Applicants’ proposed location’s compliance or noncompliance with the CB5 Cannabis Guidelines as set forth on Schedule B attached hereto, and we reserve the right to comment on the individual Applicants and their individual methods of operation with respect to other considerations set forth in the CB5 Cannabis Guidelines; therefore be it
RESOLVED, That CB5 recommends denial of those applications for premises which are not in Compliant Locations as listed on the attached schedule.
