Application from Thessabul LLC (AKA Barbounia) for a permit for an unenclosed sidewalk café at 250 Park Avenue South featuring 12 tables and 33 chairs
WHEREAS, Thessabul LLC (“Applicant”) (AKA Barbounia) is applying for a license for an unenclosed sidewalk café at 250 Park Avenue South; and
WHEREAS, The application does not meet the DCA regulations for layout and pedestrian circulation and flow, as it is rife with errors and proposed conditions that would be non-compliant and problematic, including:
- Incomplete and inconsistent architectural drawings with mis-indication of entry and service doors
- Arrangements showing unrealistically tight configuration of tables and chairs with relation to each other and to fixed architectural objects including the property boundary, columns, and door swings
- a service aisle that is not clear for circulation, but instead populated with furniture; and
WHEREAS, Although the Applicant has operated as a valuable member of the community and is a valued business in the neighborhood, Community Board Five has made clear over many years the concern about sidewalk café applications on this very block, including an existing unenclosed sidewalk café across Park Avenue owned by a shared parent company, and expects the Applicant to manage any application in this area accordingly, with a complete and accurate application including thorough pedestrian counts, which are conspicuously absent from this application; and
WHEREAS, Community Board Five strongly believes that Applicant should formally withdraw this
application, revise it to be in compliance, and resubmit; therefore, be it
RESOLVED, Community Board Five recommends denial of the application from Thessabul LLC
(AKA Barbounia) for a permit for an unenclosed sidewalk café at 250 Park Avenue South featuring 12
tables and 33 chairs.
