Newsstand application # 13910-2018-ANWS; 42nd Street between 7th and 8th Avenues
WHEREAS, Pulak Chakraborty (“Applicant”), seeks a permit to install and operate a newsstand mid-block on 42nd street between 7th and 8th Avenues; and
WHEREAS, Although the applicant both attended the public hearing and posted notification in the community, the proposed newsstand would be located in a heavily congested area and create an unnecessary burden on pedestrian flow; and
WHEREAS, The Times Square Alliance is vehemently opposed to a newsstand in this location; and
WHEREAS, Zoning laws prohibit the construction of a newsstand in this location as the proposed location is directly in front of 234 West 42nd Street, which has more than three levels of retail activity; and
WHEREAS, Community Board Five recognizes that newsstand applicants are usually individuals and small business owners and urges the Department of Consumer Affairs or the Department of Small Business Services to assist applicants in the cumbersome application process and provide a map of appropriate locations for newsstands; therefore, be it
RESOLVED, Community Board Five recommends denial of the application to install a newsstand at 42nd Street between 7th and 8th Avenues; and be it further; and
RESOLVED, Recognizing that the cost of applying for a newsstand is very high for small
business owners and operators, Community Board Five continues to request that DCA refund
the fee for any application that was deny.
