Application by Joe & The Juice New York LLC for a new unenclosed sidewalk cafe at 1758 Broadway between 56th and 57th Streets.
WHEREAS, Joe & The Juice New York LLC (the "Applicant") has submitted an application to operate a small seasonal unenclosed sidewalk café (the "Cafe") at 1758 Broadway with 5 tables and 13 chairs, all located on Broadway between 56th and 57th Streets; and
WHEREAS, The Cafe will be used for customer seating and will not have table service; and
WHEREAS, The Café’s maximum hours of operation will be 7:00 am to 8:00 pm daily; and
WHEREAS, The Applicant agreed to Community Board Five’s request to reduce the footprint of the Cafe to four tables and 11 chairs in order to facilitate greater passage for pedestrians on Broadway between the Cafe and a corner newsstand, with no tables or chairs to be placed adjacent to the newsstand; and
WHEREAS, Although the Applicant incurred a violation for operating an unauthorized unenclosed sidewalk cafe during the 3rd quarter of 2017, Applicant asserts that the violation was due to managerial oversight, and that it ceased operations of said sidewalk café immediately upon receiving the violation; and
WHEREAS, The Applicant understands and accepts that Community Board Five will withdraw any approval of the Cafe if any violations relating to the operation of said Cafe take place; therefore, be it
RESOLVED, Community Board Five recommends approval of an application by Joe & The Juice New York LLC for a new small unenclosed sidewalk café with four tables and 11 chairs at 1758 Broadway between 56th and 57th Streets.
