150 West 30th Street, New York, NY, 30TH STREET ENTERTAINMENT LLC, application for a new on-premises liquor license
WHEREAS, The applicant, 30th Street Entertainment LLC, has notified Community Board Five of its intent to apply for a new on premises liquor license for a bar/restaurant located at 150 West 30th Street (between Sixth and Seventh Avenues), New York, New York (the "Premises"); and
WHEREAS, The Premises is located on a narrow and quiet side street, with residential buildings across and adjacent to the Premises; and
WHEREAS, The Premises is located on an especially congested sidewalk, which sidewalk is already severely encroached upon by parked vehicles belonging to the New York City Police Department's Citywide Traffic Task Force; and
WHEREAS, The Premises is a huge space, comprised of 11,141 square feet of space on three floors containing three bars and a full kitchen and a total occupancy of 374; and
WHEREAS, The Premises is to be operated as a "clubhouse" sports bar and game room; and
WHEREAS, Applicant is requesting a 2am closing on Sundays-Thursdays and a 4:00am closing on Fridays and Saturdays, along with live music and DJs and bottle service; and
WHEREAS, The Premises was formerly housed "Madison Square Tavern" which operation was a public nuisance to the block because of late hours and rowdy patrons, inconsistent with the quiet nature of the block; and
WHEREAS, Residents testified with complaints of overcrowding, noise, overflow of clientele onto the street and sidewalk, and general mayhem surrounding the prior operation of the Premises, as evidence that this location is inappropriate for a liquor licensed establishment of this type; and
WHEREAS, The Applicant is a well-known nightclub operator with a history of problematic operations; and
WHEREAS, The proposed method of operation is a new concept by the Applicant being tested at the Premises and the community is concerned that if this new concept fails, the Applicant will operate the Premises as another one of its nightclubs; and
WHEREAS, The Premises' location is not well-suited for a large liquor-licensed establishment, especially one with over 11,000 square feet of patron space and occupancy as high as 374 persons; and
WHEREAS, A large number of residents appeared and testified in opposition to the application citing the concerns and issues described above; and
WHEREAS, Even after many meetings and several months of attempting to negotiate a satisfactory compromise between the Applicant and neighbors, there were several points of contention that the Applicant was unable to compromise, most notably regarding late hours of operation; and
WHEREAS, The Premises is located on a quiet side street, already congested with vehicles, which location is inappropriate for licensing such a large and high-occupancy space; therefore be it
RESOLVED, Community Board Five recommends denial of the application by 30th Street Entertainment LLC for a new on premises liquor license for a bar/restaurant located at 150 West 30th Street (between Sixth and Seventh Avenues), New York, New York.
