30 East 30th Street A/K/A 29 East 29th Street, New York, New York, 29 East 29th St (NY) Owner LLC and 29th St NY Food & Bev Operating Co LLC, D/B/A The Redbury, application for an alteration to an existing on-premises liquor license.
WHEREAS, 29 EAST 29TH ST (NY) OWNER LLC and 29TH ST NY FOOD & BEV OPERATING CO LLC (collectively, "Applicant"), has notified Community Board Five of its intention to file for an alteration to an existing on-premises liquor license for the restaurant located within the Redbury Hotel at 30 East 30th Street a/k/a 29 East 29th Street (between Park Avenue South and Madison Avenue), New York, NY; and
WHEREAS, The nature of the alteration is to add the terrace area located on the second floor (the "Second Floor Terrace") to the licensed premises; and
WHEREAS, The Second Floor Terrace includes approximately 1,500 square feet with a total capacity of 70 persons, with no patron bars; and
WHEREAS, The Second Floor Terrace is being operated solely for special events and would not be open to the public; and
WHEREAS, The Second Floor Terrace will solely be operated in conjunction with special events held in the second floor event space; and
WHEREAS, Applicant has agreed that Applicant shall:
WHEREAS, Should 29 East 29th Street Owner LLC ever contemplate a transfer of its interest in the ownership or management of the Restaurants or Second Floor Terrace ("transfer" being deemed to include a change in control of an entity or the transfer of a majority interest in an entity), such transferring party shall notify CB5 of such intent and shall require any potential transferee to agree to the conditions and stipulations contained herein; and
WHEREAS, Should 29th Street NY Food & Beverage Operating LLC ever cease to manage the Restaurants or Second Floor Terrace, it will inform CB5; and
WHEREAS, Members of the public appeared and commented regarding this application and the comments and concerns of the community were taken into consideration in negotiating these conditions and stipulations; and
WHEREAS, These agreements, stipulations and conditions will be incorporated into the Method of Operation as part of the liquor license alteration application submitted by Applicant to the New York State Liquor Authority, a copy of which shall be simultaneously submitted to CB5; therefore be it
RESOLVED, Community Board Five recommends denial of the application by 29 EAST 29TH ST (NY) OWNER LLC and 29TH ST NY FOOD & BEV OPERATING CO LLC for an alteration to an existing on-premises liquor license for the restaurant located within the Redbury Hotel at 30 East 30th Street a/k/a 29 East 29th Street (between Park Avenue South and Madison Avenue), New York, NY; unless the above conditions are adhered to and are incorporated into the method of operation of the State Liquor Authority application.
