5 West 25th Street, Luke’s Lobster XIX LLC, d/b/a Luke’s Lobster, application for a new small unenclosed sidewalk café with 8 tables and 16 chairs.
WHEREAS, Luke's Lobster (the "Applicant") is applying for a new small unenclosed sidewalk cafe ("New Cafe") license at 5 West 25th Street; and
WHEREAS, The proposed sidewalk café has a minimum of 12 feet of sidewalk space for the entire length of the sidewalk, and the address is zoned for this type of seasonal café; and
WHEREAS, The New Cafe will have 8 tables and 16 chairs and meets the requirements for unobstructed pedestrian traffic according to DCA regulations; and
WHEREAS, The New Cafe operating hours will not be later than 10:00pm from Monday through Thursday, and not later than 11 pm on Friday and Saturday; and
WHEREAS, The New Cafe will have no amplified sound whatsoever; and
WHEREAS, The Applicant has applied for a beer and wine only liquor license for the New Café and will return to the CB5 Public Safety and Quality of Life Committee for that review at a later date and will not serve any liquor unless and until it has been granted a license by the SLA; therefore be it
RESOLVED, Community Board Five recommends approval of 5 West 25th Street, Luke's Lobster XIX LLC d/b/a Lukes Lobster application for a small unenclosed sidewalk café with 8 tables and 16 chairs.
