Application by 3 Columbus Circle for a Sidewalk Construction Material Variance.
WHEREAS, The Applicant, the owner of 3 Columbus Circle, seeks to replace its sidewalk on West 57th and 58th Streets between Broadway, 7th and 8th Avenues with a non-standard cement pigment; and
WHEREAS, The NYC Department of Transportation (DoT) has determined that all New York City sidewalk construction must utilize certain standard materials and be of a certain uniform color; and
WHEREAS, The Applicant proposes to utilize a non-DoT standard black iron oxide pigment for its proposed sidewalk construction; and
WHEREAS, The addition of black iron oxide pigment to standard sidewalk construction materials would produce a slightly darker gray-colored sidewalk compared to sidewalks constructed with DOT-standard materials; and
WHEREAS, The current sidewalk around 3 Columbus Circle has had multiple repairs over many years and now presents a patchwork of different sidewalk colors; and
WHEREAS, Sidewalks utilizing black iron oxide pigment cost more to both construct and maintain compared to sidewalks constructed with only DoT-standard materials; and
WHEREAS, The Applicant has agreed to pay for all initial sidewalk construction costs and has committed to covering all future maintenance costs; and
WHEREAS, The NYC Transit Authority, Department of Buildings, and DoT have all agreed to the Applicant's request; and
WHEREAS, No members of the public expressed concerns about the proposed variation in color; therefore be it
RESOLVED, Community Board Five recommends approval of 3 Columbus Circle's Application to the use non-DOT standard cement pigment in the construction of its new sidewalk on West 57th and 58th Streets between Broadway, 7th and 8th Avenues.
