249 West 26th Street, Chelsea 26 LLC d/b/a Pars Grill House & Bar, application for a new unenclosed sidewalk café with 5 tables and 11 chairs
At the regularly scheduled monthly meeting of Community Board Five on Thursday, May 14, 2015, the Board passed the following resolution by a vote of 37 in favor; 0 opposed; 1 abstaining.
WHEREAS, Pars Grill House & Bar ("Applicant") is applying for a new unenclosed sidewalk cafe ("New Cafe") license at 249 West 26th Street between 7th and 8th Avenues; and
WHEREAS, The Applicant's previous unenclosed sidewalk cafe was temporarily discontinued about 3 years ago ("Previous Cafe") due to nearby construction on its block; and
WHEREAS, In effect the Applicant is applying for the renewal of a license for the Previous Cafe that was transferred to the Applicant from Cafe Buon Gusto in 2005; and
WHEREAS The New Cafe will have 5 tables and 11 chairs; and
WHEREAS, The New Cafe meets the requirements for unobstructed pedestrian traffic according to DCA regulations; and
WHEREAS, The New Cafe operating hours will not be earlier than 11:30 am or later than 11 pm; and
WHEREAS, The New Cafe will not have a liquor license and will not be serving alcoholic beverages to cafe customers; and
WHEREAS, Other attributes of the New Cafe will be essentially the same as the Previous Cafe; and
WHEREAS, The Applicant is primarily an eating establishment which serves Persian cuisine; therefore be it
RESOLVED, Community Board Five recommends approval of the Pars Grill House and Bar application for an unenclosed sidewalk cafe with five tables and 11 chairs at 249 West 26th Street between 7th and 8th Avenues with the condition that the Applicant provides satisfactory evidence of its previous license for an unenclosed sidewalk cafe.
