459 Park Avenue South, LENWICH 31ST PARK LLC, application for a new unenclosed sidewalk cafe
WHEREAS, Lenwich 31st Park, LLC has submitted an application seeking permission to install and operate an unenclosed sidewalk café at 459 Park Avenue South; and
WHEREAS, The café will be on the side street of East 31st Street; and
WHEREAS, The proposed unenclosed sidewalk café would have eight (8) tables of approximately and seating for sixteen (16) patrons; and
WHEREAS, The proposed unenclosed sidewalk café would be installed a minimum of 8 feet east of the curb, and would allow a minimum of 8'-0" of unobstructed pedestrian sidewalk passage on East 31st Street; and
WHEREAS, The owner has agreed to install a container for disposing of cigarettes, and the hours would be from 10AM to 8PM seasonally; and
WHEREAS, The owner will install a metal and canvas partition around the perimeter of the café; and
WHEREAS, There is no liquor license at this time; and
WHEREAS, This café meets all the legal criteria for a sidewalk café in the district, but CB5 urges the city to rethink the regulations regarding café placement in areas with heavy pedestrian flow; high street traffic; and dense foliage, as is the case at the corner of 31st Street and Park Avenue South; and
WHEREAS, The application meets the guidelines set for sidewalk cafes; therefore be it
RESOLVED, Community Board Five recommends approval of Lenwich 31st Park LLC's application seeking permission to install and operate an unenclosed sidewalk café on Park Avenue South at the corner of East 31st Street.
