345 Park Avenue South, application for a new small unenclosed sidewalk café with 3 tables and 6 chairs.
At the regularly scheduled monthly meeting of Community Board Five on Thursday, July 10, 2014, the Board passed the following resolution by a vote of 39 in favor; 0 opposed; 1 abstaining.
WHEREAS, Starr Restaurants is applying for a new unenclosed sidewalk café at 345 Park Avenue South, a commercial office and retail building, which be located on the East 26 Street side of the building; and
WHEREAS, Starr Restaurants operates numerous mid- to high-end restaurants in Philadelphia, New York and other cities; and
WHEREAS, The location was previously the restaurant Manzanilla, which closed earlier this year, and the new restaurant is intended to be a Mediterranean/Italian restaurant and has not yet been named; and
WHEREAS, The Applicant has notified its neighbors, Doral Bank (at the corner of Park Avenue South in the same building); Giraffe Hotel (directly across West 26 Street) and the 69th Regiment Armory (immediately to the east of the premises) of their plans and has received positive feedback and no complaints; and
WHEREAS, The proposed sidewalk café would include 3 tables and a total of 6 chairs, to be placed along the building facade; and
WHEREAS, The sidewalk café would allow for more than 9 feet from the curb for unobstructed pedestrian traffic; and
WHEREAS, The Applicant understands that approval of a sidewalk café application is completely separate from the requirement to obtain a liquor license specifically for the sidewalk café, that any such application must be presented to Community Board Five's Public Safety Quality of Life Committee and the NYS Liquor Authority; and
WHEREAS, The Applicant understands that any approval of a sidewalk café must not presume that an application for a liquor license for the sidewalk café will be met with approval; and
WHEREAS, The applicant has requested sidewalk café operating hours of not earlier than 10:00 a.m. and not later than 10:00 p.m. Monday through Thursday and not later than 12:00 a.m. on Friday and Saturday; therefore be it
RESOLVED, Community Board Five recommends approval of the application for an unenclosed sidewalk café with three tables and no more than six chairs at 345 Park Avenue South.
