2 Park Avenue, Application for a new unenclosed sidewalk café with 16 tables and 39 chairs
WHEREAS, Artisanal Fromagerie & Bistro, LLC is applying for a new unenclosed seasonal sidewalk café at 2 Park Avenue, a commercial office and retail building, which will be located on the West 32nd Street side of the building; and
WHEREAS, Artesenal Fromagerie & Bisto, LLC has been in operation for 14 years; and
WHEREAS, The proposed café will have no planters and no signage, tables and chairs will be brought in every night; and
WHEREAS, The Applicant has notified its neighbors of their plans and has received positive feedback, no complaints, and no one from the public attended the meeting; and
WHEREAS, The proposed sidewalk café would include 16 tables and a total of 39 chairs, to be placed along the building façade with adequate service entry and exit points that open between the sets of tables and chairs; and
WHEREAS, The sidewalk café would allow 8 feet from the curb for unobstructed pedestrian traffic; and
WHEREAS, The Applicant understands that approval of a sidewalk café application is completely separate from the requirement to obtain a liquor license specifically for the sidewalk café, that any such application must be presented to Community Board Five's Public Safety Quality of Life Committee and the NYS Liquor Authority; and
WHEREAS, The Applicant understands that any approval of a sidewalk café must not presume that an application for a liquor license for the sidewalk café will be met with approval; and
WHEREAS, The applicant has requested sidewalk café operating hours of not earlier than 11:00 a.m. and not later than 4:00 p.m Monday through Thursday and not later than 11:00 p.m. on Friday and Saturday; and
WHEREAS, The Applicant understands the committee's concerns regarding chairs at the head of certain tables obstructing the sidewalk, and has agreed to move those chairs; therefore be it
RESOLVED, Community Board Five recommends approval of the application for an unenclosed sidewalk café with sixteen tables and no more than thirty-nine chairs at 2 Park Avenue.
