Application from Grow Marketing for “Google Nexus 7 Holiday Press Event,” a commercial event in Bryant Park from November 15th through December 22, 2013
At the regularly scheduled monthly meeting of Community Board Five on Thursday, November 14, 2013, the following resolution passed with a unanimous vote of 39 in favor; 0 opposed; 1 abstaining:
WHEREAS, Grow Marketing ("Applicant") has submitted an application to hold "Google Nexus 7 Holiday Press Event," a commercial event in Bryant Park from November 15th through December 22, 2013; and
WHEREAS, Applicant failed to appear before the Committee, and refused to submit information about the event, including the identity of the commercial sponsor, citing a Non-Disclosure Agreement; and
WHEREAS, CB5 takes its role in the review of applications for special events in our parks seriously and substantively reviews the applications in order to provide input to the Parks Department; and
WHEREAS, Because of the failure by the Applicant to participate in this review process, CB5 and the public in general was denied the opportunity to learn about this event, ask questions, and provide input, resulting in the Committee's automatic denial pursuant to Community Board Five policy; and
WHEREAS, Bryant Park Corporation attempted to speak on behalf of Applicant, but could not provide sufficient details for proper public review of this event permit seeking the use of public space; therefore, be it
RESOLVED, Community Board Five recommends denial of the application from Grow Marketing for "Google Nexus 7 Holiday Press Event," a commercial event in Bryant Park from November 15th through December 22, 2013; and be it further
RESOLVED, Community Board Five insists that Bryant Park Corporation improve their management of the event permitting process, ensuring that Applicants comply with Parks Department regulations by submitting application materials within the required timeframe and preferably at least two months in advance, to facilitate proper public review of all event permit applications, and cease the implementation of Non-Disclosure Agreements entirely, as they make public review impossible and are inherently contradictory to the public interest.
