At the regularly scheduled monthly meeting of Community Board Five on Thursday, May 09, 2013, the Board passed the following resolution by a vote of 34 in favor; 0 opposed; 1 abstaining.
WHEREAS, The applicant, FRIEDFIELD BRESLIN, LLC, is applying for renewal of an unenclosed sidewalk café at 1186 Broadway at the corner of 29th Street, and
WHEREAS, The existing sidewalk café has 13 tables and 26 seats, and leaves 8 feet of sidewalk open for pedestrian traffic, and
WHEREAS, In recent years, the character of this neighborhood has changed, resulting in a growth of residential population, and an increase in the amount of pedestrian traffic, and
WHEREAS, The John Dory Oyster Bar is a popular destination for lunch and dinner, and in warmer months, the sidewalk café is filled to capacity, and tends to expand and encroach upon the sidewalk space that is supposed to be open for pedestrian traffic, and
WHEREAS, Community Board Five has received complaints regarding the overall size of the café and impediments caused by the café to pedestrian traffic, especially on the Broadway side of the corner; and
WHEREAS, Members of Community Board Five have previously made multiple attempts to reach out to the management The John Dory Oyster Bar to discuss aid complaints from neighbors and passersby; and
WHEREAS, The applicant has not responded to those attempts at communication; and
WHEREAS, The applicant FRIEDFIELD BRESLIN, LLC was invited to attend Community Board Five's May 2, 2013 Consents & Variances Committee Meeting, in order to discuss their application for renewal of their sidewalk café, and
WHEREAS, Since the applicant FRIEDFIELD BRESLIN, LLC failed to attend the Consents and Variance Committee meeting, and the committee was unable to address any concerns regarding the existing unenclosed sidewalk café, and has had no opportunity to offer suggestions on how any problems may be remedied; therefore, be it
RESOLVED, Community Board recommends denial of FRIEDFIELD BRESLIN, LLC's application for renewal of an unenclosed sidewalk café at 1186 Broadway at the corner of 29th Street.
