Newsstand application # 1422604, SEC 8th Avenue and 42nd Street
WHEREAS, The applicant seeks a permit to install and operate a newsstand on SEC of 42nd Street and 8th Avenue, and
WHEREAS, The proposed site is located directly over an active city sewer line, and
WHEREAS, Community Board Five has received a letter from the NYC Department of Environmental Protection(DEP) stating that they "cannot approve any structure being built over an existing City sewer line;" and
WHEREAS, Individuals representing 11 Times Square (the building directly behind the proposed newsstand location) were present to oppose the proposed newsstand; and
WHEREAS, Community Board Five has already recommended denial of a similar application by this applicant at this exact location in November, 2011; and
WHEREAS, All of those previous concerns, including issues with pedestrian traffic, visual obstruction, and over saturation of newsstands in the area are still of concern today; and
WHEREAS, Members of the public were also present to voice their concerns about a newsstand at this location; therefore be it
RESOLVED, Community Board Five recommends denialof the application to install a newsstand at the SEC of 8th Avenue and 42nd Street
