204 West 55th Street (between Broadway and Seventh Avenues), GINZA 3 LLC and SOUTHWICK ASSOCIATES LLC d/b/a "JELSOMINO", APPLICATION FOR ALTERATION TO AN EXISTING ON PREMISES LIQUOR LICENSE
WHEREAS, TATIANA BRUNETTI, on behalf of GINZA 3 LLC and SOUTHWICK ASSOCIATES LLC ("Applicant"), has notified Community Board Five of its intention to apply for an alteration to its existing on premises liquor license for the ground floor and cellar restaurant located at 204 West 55th Street, New York, New York (the "Premises"); and
WHEREAS, The proposed structural alterations to the Premises are inconsequential and we have no objection to the alteration for an additional bar; and
WHEREAS, In addition to the proposed structural alterations to the Premises, Applicant wishes to apply for a cabaret license for the Premises; and
WHEREAS, Applicant erroneously contends that a cabaret license is required for its operation of a karaoke bar; and
WHEREAS, In connection with its application for its initial liquor license, Applicant appeared before Manhattan Community Board Five in April 2011 and at that time agreed to not apply for a cabaret license by affidavit attached hereto; and
WHEREAS, The agreement by Applicant to not apply for a cabaret license was incorporated into the Method of Operation as part of the liquor license application submitted by Applicant to the New York State Liquor Authority; and
WHEREAS, CB5 continues to believe that a cabaret license is inappropriate at the Premises and adverse to the quality of life for the community surrounding the Premises; therefore be it
RESOLVED, Community Board Five recommends denial of the application by GINZA 3 LLC and SOUTHWICK ASSOCIATES LLC for an alteration to its existing on premises liquor license to provide for cabaret as part of the method of operation at 204 West 55th Street, New York, New York.
