330 7th Avenue, Panera LLC – New Unenclosed Sidewalk Café with 6 Tables and 12 Seats
At the regularly scheduled monthly meeting of Community Board Five on Thursday, December 13, 2012, the Board passed the following resolution by a vote of 35 in favor; 0 opposed; 1 abstaining.
WHEREAS, The applicant, Panera LLC, is applying for a revocable consent for an unenclosed sidewalk café with 6 tables and 12 seats at 330 7th Avenue, between 28th and 29th Street, and
WHEREAS, The applicant has agreed to reduce the footprint of this application so as to have only 4 tables and 8 seats, and positioned these tables against the building façade, leaving approximately 13 feet for pedestrian traffic, and
WHEREAS, The applicant has agreed to only use removable railings with slim planters integrated within the railings, to separate the tables from pedestrian traffic; and
WHEREAS, The closing hours for the sidewalk café (tables and chairs folded, locked and/or put away) will be 10:00 PM, 7 days a week, in keeping with the restaurant hours of operation; and
WHEREAS, The applicant has agreed to monitor the area to insure that there will be no standing patrons at these tables and that only seated patrons will be permitted in the cafe area; therefore be it
