Application from Awestruck Marketing Group for Marshalls’ Fabulous Found Tour in the North Plaza of Union Square Park on Thursday, September 13, 2012.

At the Executive Committee meeting of Community Board Five on Tuesday, September 11, 2012, the following resolution passed with a unanimous vote of 8 in favor; 0 opposed; 0 abstaining:

WHEREAS, Awestruck Marketing Group ("Applicant") has submitted an application to hold Marshalls' Fabulous Found Tour in the North Plaza of Union Square Park on Thursday, September 13, 2012; and

WHEREAS, The event would take place from 8:00 a.m. to 7:00 p.m., with set-up commencing at 4:00 a.m. and cleanup concluding by 10:00 p.m.; and

WHEREAS, The event would consist of a trailer parked in the North Plaza encompassing a 53' x 32' footprint, offering patrons two virtual reality dressing rooms to promote Marshalls' Fall Collection, and a runway with 10-minute fashion shows throughout the event; and

WHEREAS, The event would make use of amplified sound for recorded music and a microphone for an emcee to use during the fashion shows; and

WHEREAS, Applicant has estimated attendance between 500 and 1000, and will have between 15-20 staff supporting the event; and

WHEREAS, Applicant will be distributing gift cards and free designer giveaways; and

WHEREAS, The event would be sponsored by TJX, parent company of TJ Maxx, Marshalls and HomeGoods, and would have significant signage present, including a banner running the length of the top of the 53-foot trailer; and

WHEREAS, Applicant has made no special plan for sanitation in spite of distributing promotional materials; and

WHEREAS, Applicant has made no attempt to work with the Union Square Partnership, nor shown any willingness to post advance signage regarding the event if requested; and

WHEREAS, Applicant was uncommunicative and unwilling to cooperate with the Committee in any attempt to make the event beneficial to the community through educational or philanthropic means and is committed to having a purely commercial event; therefore, be it
