Application from Prym 1216 Street Level LLC, dba: Woodpecker by David Burke at 1216 Broadway for a new unenclosed sidewalk café on West 30th Street between Broadway and 5th Avenue
WHEREAS, Prym 1216 Street Level LLC, dba: Woodpecker by David Burke ("Applicant") has submitted an application to operate a new unenclosed sidewalk café at 1216 Broadway with 4 tables and 8 chairs on West 30th Street between Broadway and 5th Avenue; and
WHEREAS, Applicant has agreed to Community Board Five’s request that the café's hours of operation be limited to 11:30 am to 10 pm on Sundays through Wednesdays and 11:30 am to 11 pm on Thursdays through Saturdays; and
WHEREAS, The café will have no amplified sound; and
WHEREAS, Applicant will have an owner or manager on duty at all times who will be responsible for ensuring that there will be no excessive noise or disorderly conduct due to the café; and
WHEREAS, The proposed café is in compliance with the eight feet clear path requirement for sidewalk cafés as per the regulations of the DCA; therefore, be it
RESOLVED, Community Board Five recommends approval of an application from Prym 1216 Street Level LLC, dba: Woodpecker by David Burke at 1216 Broadway for a new unenclosed sidewalk café with four tables and 8 chairs on West 30th Street between Broadway and 5th Avenue.
