Application by Aero Parking Corp for an authorization by the Department of City Planning to provide for public parking garage with a maximum capacity of 188 spaces at 10 East 30th Street

WHEREAS, Aero Parking Corp has applied for an authorization pursuant to ZR Section 11-411 to retroactively extend a previously approved special permit at 10 East 30th Street and to provide for an extension of this continuance for a public parking garage with a maximum capacity of 188 spaces, including roof parking in an existing 7-story parking garage; and

WHEREAS, Community Board Five evaluates any special permit applications for proposed public parking garages in Community District Five that have an impact on the number and flow of cars in the district; and

WHEREAS, CB5 understands that there is a demand for parking spaces on the part of many residents and workers in the district; and

WHEREAS, CB5 also recognizes the need to carefully evaluate the impact of any additional parking and its effect on the traffic congestion, air quality and impact to the community; and

WHEREAS, The parking garage was originally granted a special use permit by the City Planning Commission on October 2nd, 1957; and

WHEREAS, In 1992, the special permit the applicant was granted a zoning authorization pursuant to ZR Section 11-411, extending the term of the special use permit for 10 years from October 9, 1992 to October 9, 2002; and

WHEREAS, The applicant neglected to renew their permit in 2002 and have thus been operating illegally since; and

WHEREAS, The applicant did demonstrate to the committee that legalization action was undertaken immediately upon awareness of the lapse in renewal; and

WHEREAS, The applicant has completed several safety enhancements to the project to improve traffic flow and circulation; and

WHEREAS, The applicant has completed an affidavit promising to complete additional safety repair no later than 6 months from the date of approval by the Department of City Planning; including

  1. Additional safety signage indicated on presented drawings
  2. New light and sound garage exit alarms
  3. New convex mirror at the exit lane
  4. New wheel stops with yellow stripes
  5. New speed bumps at all lanes entering and exiting the garage; and

WHEREAS, The use is appropriate in its current form; therefore be it

RESOLVED, Community Board Five recommends approval of Application # N 170062 ZAM and N 170063 ZAM by Aero Parking Corp for an authorization by the Department of City Planning pursuant to ZR Section 11-411 to retroactively extend a previously approved special permit at 10 East 30th Street and to provide for an extension of this continuance for a public parking garage with a maximum capacity of 188 spaces, including roof parking in an existing 7-story parking garage.
