Resolution for DOT to amend nighttime parking regulations on Saturday and Sunday mornings between 1am and 6am on West 39th Street )between 5th and 6th Aves)

At the monthly meeting of Community Board Five on Thursday, June 12, 2014, the Board passed the following resolution with a vote of 30 in favor, 0 opposed, 2 abstaining:

WHEREAS, Nighttime Parking Regulations have proven to be an effective last resort to ameliorate loud noise at night driven by crowds of people exiting nightclubs (e.g., in CB5's Restricted Licensing Area); and

WHEREAS, Years ago, DOT imposed Nighttime Parking Regulations on W. 39th St between 5th and 6th avenues prohibiting parking between 10pm and 6am 7 nights a week to facilitate order on what was a block with a concentration of nightlife; and

WHEREAS, Community Board Five received a petition from the Garment Center BID and from merchants on the block asking for all Nighttime Parking Regulations to be removed since the character of the neighborhood has evolved away from nightlife over the years and the regulations are a burden on commerce; and

WHEREAS, Community Board Five heard from residents and merchants in the area supporting removing Nighttime parking regulations on the block during the week but keeping them in place in some form on weekends; and

WHEREAS, The NYPD's Midtown South Precinct recommended keeping Nighttime Parking Regulations on the block from 1am to 6am weekends but otherwise supported removing the Nighttime Parking Regulations during the week; and

WHEREAS, In Committee, petitioners suggested a compromise with the regulations remaining on weekends would meet their needs; and

WHEREAS, The compromise has the support of residents, businesses and the NYPD; therefore be it

RESOLVED, Community Board Five requests the Department of Transportation amend Nighttime Parking Regulations to prohibit parking only on Saturday and Sunday mornings, to between 1AM and 6AM, on West 39th St, between 5th and 86h Avenues.
