1800 Broadway Bakery, LLC (between 58th Street and Central Park South) D/B/A Maison Kayser Bakery, application for a renewal revocable consent to install an unenclosed sidewalk cafe.

At the regularly scheduled monthly meeting of Community Board Five on Thursday, April 10, 2014, the Board passed the following resolution by a vote of 33 in favor; 0 opposed; 1 abstaining.

WHEREAS, 1800 Broadway Bakery, LLC has submitted an application seeking permission to install and operate an unenclosed sidewalk café outside of Maison Kayser Bakery, located at 1800 Broadway, between West 58th Street and Central Park South; and

WHEREAS, The proposed unenclosed sidewalk café would have seven (7) tables at 4'-0" X 2'-0" and seating for twenty-seven (27) patrons; and

WHEREAS, The proposed unenclosed sidewalk café would be installed 15'-6" east of the curb, and would allow a minimum of 8'-0" of unobstructed pedestrian sidewalk passage, the narrowest point being between the proposed café and the existing tree pit railing; and

WHEREAS, The sidewalk at Broadway between West 58th Street and Central Park South registers heavy pedestrian traffic; and

WHEREAS, Maison Kayser Bakery is located in proximity to the storefronts on the ground floor of a large residential apartment building, known as 240 Central Park South, which is an individual designated landmark; and

WHEREAS, The previous tenant in this location, AQ Kafe LLC, had operated a small unenclosed café outside of their establishment, and there are not any known reports of disturbances or complaints; and

WHEREAS, Maison Kayser Bakery is open for business from 7:00 am until 11:00 pm daily, and Manhattan Community Board Five recommends that the proposed unenclosed sidewalk café open for business no earlier than 8:00 am daily, and close completely no later than 10:00 pm on Sundays through Thursdays, and no later than 12:00 am on Fridays and Saturdays; and

WHEREAS, At the time the applicant's representative presented their proposal, the hours of operation for the proposed unenclosed sidewalk café were unknown as well as an agreement to follow the time requirements above; therefore be it

RESOLVED, Community Board Five recommends denial of 1800 Broadway Bakery, LLC's application seeking permission to install and operate an unenclosed sidewalk café on Broadway between West 58th Street and Central Park South unless the sidewalk café is open for business no earlier than 8:00 am daily, and closes completely no later than 10:00 pm on Sundays through Thursdays, and no later than 12:00 am on Fridays and Saturdays.
