253 5th Avenue at 28th Street, LULU & Me LLC dba Lulu & Me, application for a new unenclosed sidewalk café with 2 tables and 8 seats.
At the regularly scheduled monthly meeting of Community Board Five on Thursday, March 14, 2013, the Board passed the following resolution by a vote of 34 in favor; 0 opposed; 1 abstaining.
WHEREAS, The applicant seeks to operate a new unenclosed sidewalk café at 253 5th Avenue with 2 tables and 8 chairs; and
WHEREAS, The proposed cafe would have a relatively small footprint with no railings leaving more than 9 feet of space or 12 foot of shared space for pedestrian traffic; and
WHEREAS, The proposed location is directly next to another sidewalk cafe of a larger size and width; and
WHEREAS, The neighboring café has been in existence for some time with no complaints and traffic flows easily past that neighboring cafe; and
WHEREAS, The applicant has agreed to close the proposed cafe by 10 pm Sunday through Wednesday and 11pm Thursday, Friday and Saturday; and
WHEREAS, The applicant has agreed that there will be no amplified sound at the proposed sidewalk cafe; and
WHEREAS, There were no complaints on file and no one was present to speak against this application; therefore be it
RESOLVED, Community Board Five recommends approval of the proposed sidewalk cafe for LuLu and Me at 253 5th Avenue.
