230 West 54th Street, On 54th LLC, d/b/a Café America, application for an unenclosed sidewalk café with 10 tables and 34 seats

At the regularly scheduled monthly meeting of Community Board Five on Thursday, February 14, 2013, the Board passed the following resolution by a vote of 32 in favor; 0 opposed; 1 abstaining.

WHEREAS, The applicant, On 54th LLC, d/b/a Café America, is applying for a revocable consent for an unenclosed sidewalk café with 10 tables and 34 seats; and

WHEREAS, The proposed sidewalk café would be located on both Broadway and 54th Street; and

WHEREAS, Due to concerns of heavy pedestrian traffic and pedestrian safety expressed by members of Community Board Five, the applicant agreed to remove the 3 tables on the 54th Street side of the restaurant until after the construction across the street is finished and they can return to CB5 at a later date; and

WHEREAS, Members of CB5 have also expressed concerns over the line formed prior to the taping of The David Letterman show and how that line in conjunction with the proposed sidewalk café could create a dangerous situation with pedestrians being forced to walk in the street; and

WHEREAS, The applicant has agreed to restrict the hours on the 3 north most tables (which are closest to the theater) to operate only from 5pm – 10pm on Monday thru Thursday when there is a taping of the show; and

WHEREAS, The hours of operation for the 4 remaining tables and on days when there is no taping of The Letterman Show would be 10am to 10pm  (with tables and chairs folded, locked and/or put away by 10pm); and

WHEREAS, The applicant will have no amplified sound at the café; and

WHEREAS, The application appeared to be compliant with DCA regulations; and

WHEREAS, No comment or objection was raised by members of the public; therefore be it

RESOLVED, Community Board Five recommends approval of the application for a revocable consent for an unenclosed sidewalk café on Broadway at 230 West 54th Street.
