RESOLUTION FOR DOT TO IMPLEMENT NIGHTIME PARKING REGULATIONS BANNING PARKING ON FRIDAY AND SATURDAY NIGHTS BETWEEN 11PM and 6AM on West 30th Street (between 7th and 8th Aves), New York, New York

At the monthly meeting of Community Board Five on Thursday, April 12, 2011, the Board passed the following resolution with a vote of 34 in favor, 3 opposed, 2 abstaining, 1 present but not entitled to vote:

WHEREAS, Community Board Five has received a petition with 32 signatures asking for Nighttime Parking Regulations on weekend nights on West 30th St. between 7th and 8th Avenues; and

WHEREAS, For more than a decade, Community Board Five's Public Safety and Quality of Life Committee has identified this block as one of the most problematic in our district for nighttime noise and disturbances affecting residential quality of life; and

WHEREAS, Community Board Five has attempted many solutions to the noise problems over the years - with mixed success - including but not limited to:

WHEREAS, Nighttime Parking Regulations have proven to be an effective last resort to ameliorate loud noise at night driven by crowds of people exiting nightclubs (e.g., in Community Board Five's Restricted Licensing Area); and

WHEREAS, The NYPD's Midtown South Precinct has recommended that Nighttime Parking Regulations be applied to this block; and

WHEREAS, Community Board Five seeks to balance the public interest in maintaining street parking for commercial and residential users of the block with this request from a single group of residents (albeit seemingly a majority of residents of the block), such that CB5 would only consider approving this request in extraordinary circumstances, which we believe are met in this instance; therefore be it

RESOLVED, Community Board 5 requests the Department of Transportation to implement Nighttime Parking Regulations Banning Parking on Friday and Saturday Nights, from 11pm to 6am, on West 30th St, between 7th and 8th Avenues
