Request for a Change in Parking Regulations on West 38th Street between Fifth & Sixth Avenues

WHEREAS, Community Board Five has been approached by a number of residents of building located on Sixth Avenue and West 38th Street to examine a change of parking regulations; and 

WHEREAS, West 38th Street between Fifth and Sixth Avenues is located in the Garment District and in a manufacturing zone and Community Board Five has over the last several years expressed strong concern about the impact of regulatory changes to the health and survival of the garment industry; and

WHEREAS, Current signage on the block indicates "No Standing except Commercial Vehicles Metered Parking 6 AM to 7 PM Monday to Friday"; and

WHEREAS, The residents are seeking to change the regulations to "No Standing except Commercial Vehicles Metered Parking 7 AM to 6 PM Monday to Friday;" and

WHEREAS, The Community Board has reached out to the Fashion Center BID and has not heard any significant concerns about the proposal; and

WHEREAS, The proposed change would provide residents some relief and allow them to move their cars one hour later in the morning and would also permit several of the restaurants a bit more convenience by allowing their patrons to park on that street an hour earlier; and

WHEREAS, The Department of Transportation has asked that proposed changes to parking to be reviewed by the Community Board before they take action; and

WHEREAS, Representatives from the surrounding residential buildings in attendance at the Transportation & Environment committee meeting confirmed their support for the proposed changes; therefore, be it

RESOLVED, Community Board Five recommends that the parking regulations on West 38th St. between 5th and 6th Avenues be changed to: "No Standing except Commercial Vehicles Metered Parking 7 AM to 6 PM Monday to Friday."   

The above resolution passed with a vote of 38 in favor, 0 opposed, 1 abstaining.
