State Licenses and Permits

7 West 20th Street (between Fifth and Sixth Avenues), Aleo Restaurant Corp. d/b/a "Aleo", application for renewal of an existing liquor license.

WHEREAS, ALEO RESTAURANT CORP. ("Applicant"), has notified Community Board Five of its intention to renew the on premises liquor license for the restaurant "Aleo" located at 7 West 20th Street (between Fifth and Sixth Avenues), New York, New York (the "Premises"); and

WHEREAS, The Premises is located within Community Board Five's Restricted Licensing Area, an area deserving of heightened scrutiny of liquor license applications and renewals; and

WHEREAS, Community Board Five has received several complaints regarding the method of operation of the Premises, most particularly with respect to certain outdoor parties hosted at the Premises from time to time; and

WHEREAS, The Premises consists of approximately 1,250 square feet on the ground floor and 1,320 square feet in the basement of useable public space, and an additional 500 square feet in the backyard; and

WHEREAS, The Premises will be operated exclusively as a restaurant ("Restaurant Use"), with a total of approximately 28 tables, 65 seats, and 9 bar stools, with a full kitchen; and

WHEREAS, The total capacity of the Premises is 74; and

WHEREAS, The Premises includes no patron bar and 1 service bar; and

WHEREAS, The Applicant has agreed that Applicant shall:

1.                  Not make use of promoter-driven events for the Restaurant

2.                  at all times remain responsible for and in complete control of the Premises and its patrons and (ii) all material positions of operation shall be the employees of the Applicant at all times;

3.                  agree to keep the establishment exclusively as a restaurant, with hours of operation :

4.                  agree to keep the outdoor space exclusively as a restaurant, with hours of operation :

                                                              i.      Sunday                                    12:00PM - 10:00 PM

                                                          iii.      Tuesday                       12:00PM - 10:00 PM

                                                          iv.      Wednesday                  12:00PM -  10:00 PM

                                                        vii.      Saturday                      4:00PM -  11:00 PM

 

5.                  strictly comply with and adhere to the plans for the operation of the business, as set forth herein;

6.                  not incorporate a DJ or live music in backyard area, and agree to keep the stereo ambient music conducive to an eating establishment only;

7.                  be in compliance with  all applicable zoning, building, fire and other codes,

8.                  arrange for private garbage pickup and its garbage will be stored in a manner so as not to cause a disturbance or annoyance to its neighbors;

9.                  meet with neighbors and CB5 on a regular basis if requested and shall provide a 24-hour hotline to a live manager or owner to immediately address any complaints from the community; and

WHEREAS, Should Applicant ever contemplate a transfer of its interest in the operation at the Premises ("transfer" being deemed to include a change in control of an entity or the transfer of a majority interest in an entity), Applicant shall notify CB5 before such transfer is made and shall require any transferee to agree to the conditions and stipulations contained herein; and

WHEREAS, Should PETER RAIMONDI ever contemplate a transfer of his interest in Applicant so that he does not have a controlling management interest in Applicant ("transfer" being deemed to include a change in control of an entity or the transfer of a majority interest in an entity), notice shall be given to CB5 before such transfer is made and any transferee shall be required to agree to the conditions and stipulations contained herein; and

WHEREAS, These agreements, stipulations and conditions will be incorporated into the Method of Operation as part of the liquor license application submitted by Applicant to the New York State Liquor Authority, a copy of which shall be simultaneously submitted to CB5; and

WHEREAS, Members of the community expressed support for the approval of the renewal subject to the foregoing conditions and stipulations; therefore be it

RESOLVED, That Community Board Five recommends denial of the application by ALEO RESTAURANT CORP. to renew the on premises liquor license for the restaurant "Aleo" located at 7 West 20th Street (between Fifth and Sixth Avenues), New York, New York, unless the above conditions are adhered to and are incorporated into the method of operation of the State Liquor Authority application.

The above resolution passed by a vote of 34 in favor; 0 opposed; 1 abstaining.
